 In British Columbia, an uncontested divorce (often referred to as a “desk order divorce”) is a streamlined process for obtaining a divorce without a court appearance. This is not available where the outstanding issues have either not been agreed to by the parties or determined by the court.

It is important to note that while a desk order divorce is generally straightforward, legal advice is recommended to ensure your rights are protected and that all necessary documents are correctly prepared and filed.

This process is designed to be more efficient and less costly than a contested divorce that requires court appearance and hearings and is only available in situations where agreement has been reached on key issues such as property division, support and parenting matters, or the court has made determinations.

Requirements for an Uncontested Divorce:

  • At least one year of separation (unless adultery or cruelty applies)
  • Agreement on all family law matters, including parenting, support, and property
  • Properly signed and witnessed separation agreement, if applicable
  • Complete and accurate court forms, including financial disclosures if required

If children are involved, the court must be satisfied that arrangements are in place for their support and well-being.
