A wills variation claim is not the only way to challenge a will. There are other situations where a will or a portion of it may be invalid, such as where:

  • the will-maker was improperly influenced or coerced by another person;
  • the will-maker did not have the mental capacity to prepare a will;
  • the will does not comply with the formal requirements of the Wills, Estates and Succession Act;
  • there are competing wills;
  • the will-maker revoked the will; or
  • a term of the will is unclear or invalid.
